Husband and . . .?

Well, it finally happened.

For those of you who don't know, I'm a title officer for a major title insurance company during the day. (Real Estate stuff)

Anyway, today I received the phone call I've been waiting on for months now. A lender called me up and asked my opinion:

Two men (her borrowers) purchased a condominium in Washington State as joint tenants with rights of survivorship. (i.e. if either of them dies, the other inherits the full title to the property without any need for the estate to be probated, etcetera.)

They are now taking out an equity line of credit on their condo.

Last month, they were married in Oregon.

They want to sign the deed of trust as Mr. X and Mr. Y, husband and wife.

Hmmm.

I recommended that they sign as "married persons," but we'll see if that flies. I'm curious to see where this all ends up myself. If they want to sign "husband and wife," I'd love to see them get their wish but we'll have to see how it plays out.

In the end, it's my call. That's what they pay me to do. But I think I'll be having many, many discussions with legal counsel on this one . . .

Hmmm.

Just thought you all might get a kick out of this.
