Proposition 64

Full Text of Proposition

What does it do? Places restrictions on the right to sue businesses for violations of California's Unfair Business Practices laws. The main one is that only the California Attorney General or California District Attorneys can bring suit in the absence of a specific client who is claiming damages, and the suits have to meet the requirements for a class action suit.

How I plan to vote: No

Why? The whole thing feels slightly fishy to me. Proponents are big on the idea that it protects small businesses from "shakedown" lawsuits by lawyers who sue for picayune violations of the law just so they can pocket the fee. (Or even take a payoff in exchange for not bringing the suit.) I have no doubt that such lawsuits happen, and that this is a terrible thing, but this seems like too much of a blunt-instrument solution.
